Darwinson A. Valdez

Attorney

A native Spanish speaker and graduate of Indiana University’s McKinney School of Law, Darwinson Valdez has a critical interest in immigration law. In law school, Valdez served as the President of the Hispanic Law Society and was a member of the Black Law Student Association. He interned in the U.S. District Court in New York, and later worked as a law clerk for the Indiana Supreme Court. Valdez has always shared a deep concern for immigration law as it impacts individuals, families, and businesses.

1. Is the immigration lottery real?

Yes, absolutely. It is NOT a ruse to locate those who are here illegally.

2. Does marriage to a U.S. citizen automatically get you a Permanent Resident Card?

No. It may take from three months to two years to complete the Permanent Resident Card process.

3. Can my employee’s spouse work?

L-2 visa holders (spouses of L-1 visa holders) and spouses of E visa holders have recently been allowed to apply for employment authorization.

4. Can a visa be obtained in the United States?

As of 2004, all foreign nationals requiring new visas must apply for their visas at a U.S. embassy or consulate outside the United States of America.

5. Can a visa be obtained in Canada for the U.S.?

Yes, absolutely!

6. Does a Canadian citizen need a visa to visit the U.S.?

No. However you do now require a passport or appropriate I.D. to cross the border from Canada to the U.S. (and vice versa).

7. What is the difference between a Green Card and a Permanent Resident Card]

None, they are the same. The Permanent Resident Card took the name of “Green Card” because the card color was Green.
